Accra April 12, GNA – An Accra Circuit Court has rescinded the bench warrant against the Administrator of the Accra Psychiatric Hospital who released an accused person referred to the facility for medical care.
On March 24, this year, the court ordered the arrest of the Administrator of the Accra Psychiatric Hospital for releasing an accused person who was referred to the facility for medical care.
The Administrator released the accused to his grandmother without recourse to the court.
The Administrator was summoned to appear before the court but was absent when the matter was called earlier on March 23.
At the court sitting on Wednesday, the accused Nicolas Dzifanu a 20 year old porter and his mother appeared before the court after the court had asked the Administrator to produce them.
The court presided over by Mrs Abena Oppong Adjin-Doku warned the grandmother of the accused person not to send his grandson to any prayer camp but adhere to the days for medical review of the accused person at the medical facility.
According to the court accused ailment was not a spiritual one adding that a report provided by the Accra Psychiatric Hospital indicated that there was space to accommodate him.
The court was informed by Detective Inspector Kofi Atimbire that the Administrator of the hospital and the Medical Doctor had released Dzifanu to the grandmother.
They were therefore subpoenaed to appear before the court on March 23, this year to explain why they released the accused to his grandmother after the court had convicted him of a second degree felony.
Detective Inspector Atimbire told the court that the Hospital Administrator was duly served but failed to appear in court.
Dzifanu was convicted for defilement by having anal sex with a seven-year-old boy.
Dzifanu a head porter is said to have had anal sex with a seven-year-old at Community 18, Lashibi. The complainant is unemployed and mother of the victim.
The fact of the case as presented in Court was that Dzifanu lives in the same house with the complainant at Community 18 Lashibi.
On March 3, last year, at about 19:00 hours the complainant wanted to bath the victim but she could not find him and begun searching for him in the area until 12:00 am.
During the search the complainant was informed by the accused’s grandmother that she heard the accused person conversing with the victim earlier.
Complainant, therefore, went to the accused person room only to find him having anal sex with the victim. She raised an alarm and accused person was arrested.
The victim was sent to the hospital after the complainant had been issued with a medical report form.
The accused in his caution statement admitted the offence.
